Terms & Conditions

The guest acknowledges notice that the property is one to which Section 12(2) and Paragraph 8 of schedule 4 of the Housing (Scotland) Act 1988 applies whereby the guest has the right to occupy the flat for the purpose of his/her stay only and whereby there will be no security of tenure within the terms of the said Act.

The guest agrees to use this property solely for the purpose of a private corporate residence for the maximum of people shown on the booking correspondence and agrees not to:

  • use the property for any improper, illegal, or immoral purposes.
  • to sub-let the property.
  • cause (nor allow any guests or visitors to cause) any nuisance, annoyance or disturbance to neighbours, or to the Landlord, or to the Landlord’s agent
  • smoke or allow smoking in the property
  • keep pets in the property.
  • act in an aggressive manner towards Haymarket Apartments staff or representatives

Failure to comply with the requirements above will result in the agreement being terminated.

This Agreement will be governed by and construed in accordance with the Law of Scotland and the parties submit to the jurisdiction of the Scottish Courts.

SMOKING POLICY:

All apartments are strictly non-smoking, guests who smoke in an apartment will be held liable for a £200 deep cleaning charge.

DEPOSIT:

Please note that all stays are subject to a £100 deposit which will be taken from the debit or credit card provided. The deposit will be refunded to the card after the completion of an apartment inspection, provided that the maximum occupancy and guest noise level terms have not been breached.

OCCUPANCY:

Please note that our apartments are not intended as a venue for social gatherings, parties or other such events. Each apartment type has a maximum occupancy level, which if exceed will result in forfeit of your deposit and may lead to your immediate removal from the premises without further notice and without refund of any accommodation charges.

The maximum occupancy for each apartment is as follows;

Apartment 1 - 2 Persons

Apartment 2 - 2 Persons

Apartment 3 - 6 Persons

Apartment 4 - 4 Persons

Apartment 5 - 4 Persons

Apartment 6 - 3 Persons

Apartment 7 - 4 Persons

PET POLICY:

No Pets are allowed on the premises

DAMAGES:

Guests will provide a debit/credit card on booking, details of which we be held until the end of the guests stay. The Guests in doing so give permission for the costs of any damages to be charged to their debit or credit card without prior recourse to them on the understanding that, as soon as is reasonably practicable, this will be notified to them.

The guest agrees to repair, replace or pay for any items damaged through neglect, misuse, or carelessness on the part of the guest or any visitors to the property.

When damage occurs, either by negligence or deliberate action of a guest, the guest agrees to indemnify the Owner against any associated losses, including lost income and the sourcing of alternative accommodation should that be required. The guest will notify the Owner of any repairs which are necessary and allow the Owner access to carry out repairs.

If a damages deposit has been paid prior to arrival, the deposit will be refunded without interest to the Guests within 21 days of their vacation of the property, under deduction of all reasonable costs for remedying any damage to the property or the contents thereof incurred by the Company on behalf of the owner as a result of the actions of the guests. This includes the reasonable cleaning costs in the event that the property is left in a dirty or very untidy condition.

GUESTS COMPLAINTS DUE TO NOISE:

In the event that we receive complaints regarding noise levels from your apartment, you may be requested to leave the building immediately and both your accommodation and deposit charges will be forfeited. In the event that guests refuse to vacate the apartment, having been asked to do so, the police will be asked to attend.

PAYMENT POLICY:

Full payment is due 7 days prior to arrival and will be charged to the debit or credit card provided. Once payment is made, details for check-in and access will be sent to the guest to the e-mail provided.

If payment cannot be taken using a valid debit or credit card 7 days prior to the check-in date, Haymarket Apartments reserves the right to cancel the reservation and take another reservation from an alternative guest. No compensation will be provided to the guest should we have to cancel their reservation. Please make sure a valid debit or credit card is provided at the time of booking including date of expiry and valid e-mail address is provided so we can contact you.

For Advance Purchase Plans which are bookable a minimum of 14 days in advance  the full amount of the booking is due at time of booking and is non-refundable.

Payment can be made by Credit/Card/Debit Card and please note that payments made by credit card are subject to a 2.5% surcharge. Should you wish to avoid the surcharge you can pay by debit card or alternatively contact us to arrange a bank transfer.

CANCELLATION POLICY:

For bookings of 14 nights or less the following cancellation policy applies:

If cancelled up to 7 nights prior to arrival 100% of the first night will be charged. If cancelled later or in the case of a no-show the full amount of the reservation will be charged.

For bookings of more than 14 nights the above policy does not necessarily apply and the individual booking will be subject to a pre-arranged cancellation policy at the time of booking.
